By accessing or using the Website or ordering any services, you ("Customer," "you," or "your") agree to be bound by these Terms.
1. Scope of Services
1.1 The Company provides DNA-related services (All the tests mentioned are not medical genetic tests, these are genetic predisposition tests.), which may include genetic testing kits, data analysis, interpretation reports, and access to digital platforms (collectively, the "Services").
1.2 The Services are provided for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment.
2. Eligibility
2.1 You must be at least eighteen (18) years old or have valid legal guardian consent to use the Services.
2.2 By using the Services, you represent that you are legally authorized to submit the biological sample and/or genetic data provided.
2.3 If you submit a sample on behalf of another person, you confirm that you have obtained all necessary legal consents.
3. Orders and Contract Formation
3.1 Orders for Services are placed via the Website or other authorized channels.
3.2 A binding agreement is formed only once the Company confirms acceptance of the order and, where applicable, payment is received.
3.3 The Company reserves the right to refuse any order at its sole discretion, including for regulatory, ethical, or technical reasons.
4. Customer Obligations
4.1 You shall provide complete, accurate, and truthful information required to perform the Services.
4.2 You are responsible for following sample collection and submission instructions precisely.
4.3 You acknowledge that genetic testing has inherent scientific limitations and that results may not be definitive.
4.4 You shall comply with all applicable laws regarding genetic data, consent, and sample submission.
5. Performance of Services
5.1 The Company shall perform the Services with reasonable care and professional diligence in accordance with applicable laws and industry standards.
5.2 The Company may use subcontractors, laboratories, or technical partners to fulfill the Services.
6. Results and Delivery
6.1 Test results and reports shall be delivered electronically either (i) through secure access via the online user account or platform provided by the Company, and/or (ii) as a password-protected PDF file sent directly to the email address provided by the Customer. The Customer acknowledges and agrees that electronic delivery constitutes valid and complete delivery of the results.
6.2 Any delivery timelines provided are estimates only and not guaranteed.
6.3 The Company is not responsible for delays caused by logistics, regulatory requirements, or force majeure events.
7. Fees and Payment
7.1 Prices for Services are displayed on the Website or agreed in writing prior to order confirmation.
7.2 All payments must be made in full at the time of placing the order, unless expressly stated otherwise by the Company in writing at the point of order.
7.3 Except where mandatory consumer law applies, fees are non-refundable once processing has begun.
8. Samples and Storage
8.1 Biological samples are processed solely for the purpose of providing the Services.
8.2 Samples may be destroyed after completion of the Services unless extended storage is expressly consented to by you.
8.3 The Company is not obligated to return submitted samples.
9. Research Participation (Optional)
9.1 Participation in research or secondary use programs is voluntary and subject to separate consent and terms.
9.2 Refusal to participate does not affect access to purchased Services.
10. Intellectual Property
10.1 All intellectual property rights related to the Website, Services, methodologies, software, and reports remain the exclusive property of the Company or its licensors.
10.2 You may use the results solely for personal, non-commercial purposes unless otherwise agreed in writing.
11. Data Protection and Privacy
11.1 The Company processes personal and genetic data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Estonian law.
11.2 Detailed information on data processing is provided in the Privacy Policy, which forms an integral part of these Terms.
12. Disclaimer
12.1 The Services are provided "as is" and "as available."
12.2 The Company does not guarantee that the Services will meet specific expectations or purposes beyond those expressly stated.
13. Limitation of Liability
13.1 To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages.
13.2 The Company's total liability shall not exceed the amount paid by you for the specific Service giving rise to the claim.
14. Force Majeure
14.1 Neither party shall be liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, regulatory actions, or supply chain disruptions.
15. Governing Law and Jurisdiction
15.1 These Terms are governed by the laws of the Republic of Estonia.
15.2 Any disputes shall be subject to the exclusive jurisdiction of the Estonian courts, unless mandatory consumer protection laws provide otherwise.
16. Amendments
16.1 The Company may amend these Terms at any time by publishing an updated version on the Website.
16.2 Continued use of the Services after publication constitutes acceptance of the revised Terms.
